Dear Mr. Sterling,

                            Re: Your reference # M03-04504 (previously # M03-02157, # M03-02821)

Thank you for your direct answer dated July 14, 2003, to my letter of July 7th, 2003. We are both in agreement. The College of Nurses of Ontario is under the jurisdiction of the Minister of Health and Long-Term Care (last sentence of your July 14, 2003, letter).

I do recognize that the issues must be addressed by the Minister of Health and Long_term Care, the Honourable Tony Clement, in that the College of Nurses falls directly under his ministry and the Health Professions Appeal and Review Board is under his persuasion. In a like manner, I do appreciate that the boundaries between ministries must be respected.

Having only received a reply (hand dated June 26th, 2003) to my March 28th, 2003 communique to the Minister of Health and Long_term Care, the Honourable Tony Clement, on July 8th, 2003, my options were somewhat limited if I was to respect the authority of your party’s position as the governing body in our Ontario. It was also my hope that your understanding and respect for the law and legal procedures would be persuasive and assist the Honourable Tony Clement in recognizing his responsibilities in regards to the College of Nurses of Ontario. Unfortunately, it appears from the answer I received, dated June 26th, 2003, from the Ministry of Health and Long-Term Care, my efforts were in vain.

Again, respecting the boundaries between ministries and the limitations this causes you, while recognizing that you as the Attorney General of Ontario (as taken from your website):

(b) shall see that the administration of public affairs is in accordance with the law;

(c) shall superintend all matters connected with the administration of justice in Ontario;

(g) shall advise the heads of ministries and agencies of Government upon all matters of law connected with such ministries and agencies;

(i) shall superintend all matters connected with judicial offices;

I am today soliciting the intervention of the Premier of Ontario and Minister of Intergovernmental Affairs, the Honourable Ernie Eves. I trust this will facilitate matters with respect to intergovernmental affairs.
